US safety regulators are evaluating a formal petition to investigate Tesla robotaxis over allegations that the vehicles are driving too fast through active school zones. The review involves approximately 1,000 Model Y and Cybercab vehicles operating with Tesla's Automated Driving System (ADS) engaged.
According to the National Highway Traffic Safety Administration (NHTSA), its Office of Defects Investigation received the defect petition on September 23, 2026. The petitioner alleges that the automated driving system exceeds posted speed limits in active school zones, where lower speeds are legally mandated to protect children.
The scrutiny adds to existing regulatory challenges for Tesla. The Cybercab, which launched earlier in 2026, is already under investigation for lacking standard controls such as side mirrors, pedals, and a steering wheel. NHTSA has also opened an investigation into Tesla's Full Self-Driving system over traffic violations, including running red lights and driving on the wrong side of the street.
Safety concerns around automated vehicles near schools extend beyond Tesla. Rival operator Waymo has previously faced inquiries after its robotaxis were reported illegally passing school buses and striking a child near a California elementary school. NHTSA is currently evaluating the claims before deciding whether to launch a full defect investigation.
